Welcome to the Energy 106 website (the Site). The Site is operated by Energy 106 (the Station). By using the Site, you agree to these Terms & Conditions (the Terms). If you do not agree, please do not use the Site.

1) Who we are

Energy 106 is a commercial radio service broadcasting in Northern Ireland and online. References to “we”, “us” and “our” are to the Station. References to “you” and “your” are to users of the Site.

For broadcast complaints, please see our Complaints page first; if unresolved, you may contact Ofcom (our regulator).

2) Using the Site

• You may use the Site for lawful, personal and non-commercial purposes only.

• Do not try to damage, interfere with, or reverse-engineer the Site or streams, or attempt unauthorised access to our systems.

• Do not copy, record, rebroadcast, scrape, or redistribute our audio streams or content without written permission.

• You must not upload or transmit anything unlawful, defamatory, infringing, obscene, hateful, or otherwise objectionable.

We may suspend or terminate access if you breach these Terms.

3) Accounts & interactive features

Some features (e.g., competitions or comment areas) may require you to provide details. You must keep any login credentials confidential and ensure information you provide is true and up to date. We may disable any account if, in our reasonable opinion, you have not complied with these Terms.

4) Intellectual property

All content on the Site and in our streams (including audio, logos, artwork, text and code) is protected by copyright, trade mark and other IP rights. Energy 106, AdSync, our logos and show names are our trade marks or are used with permission. You may:

• view pages, stream audio and print a single copy for personal use;

• link to our homepage in a way that is fair and legal and does not damage our reputation.

You may not use our content or trade marks for any commercial purpose without our written consent.

5) Streaming, apps & smart speakers

We provide access to live streams and on-demand content via this Site, our apps (iOS/Android), Radioplayer UK, TuneIn and smart speakers. Availability and quality may vary depending on your device, location and connection. Data charges from your provider may apply. We may update, suspend or withdraw any stream or feature without notice.

6) Advertising, links & third-party services

Our Site and streams may include advertising, sponsorships and links to third-party websites, players or services.
We are not responsible for third-party content, privacy practices or terms. Any dealings you have with third parties are between you and them.

7) Competitions & promotions

Competitions, promotions and votes hosted by us are subject to specific rules published for each promotion. If those rules conflict with these Terms, the promotion rules apply to the extent of the conflict.

8) User content & takedown

If you submit content (for example, messages, audio, images or comments), you:

• grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, adapt, publish and communicate that content in connection with our services; and

• confirm you have the right to grant that licence and that your content does not infringe anyone’s rights or break the law.

We may remove user content at our discretion.

We collect and use personal data as set out in our Privacy Notice.
By using the Site you acknowledge our use of cookies and similar technologies as described there.

10) Availability & changes

The Site is provided “as is”. We do not guarantee that it will be available, secure, error-free or compatible with all devices/browsers.
We may change, suspend or withdraw any part of the Site at any time.

We may update these Terms occasionally.
The version date at the top tells you when we last changed them. Continued use of the Site means you accept the updated Terms.

11) Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so (including liability for death or personal injury caused by negligence or for fraud).

Subject to the above, we will not be liable for: loss of profit, revenue, business, goodwill, data or any indirect/consequential loss, or any loss caused by events outside our reasonable control, including network or device failures and third-party services.

12) Indemnity

You agree to indemnify us against all claims, losses, damages and costs arising from your breach of these Terms or misuse of the Site or our content.

13) Governing law

These Terms are governed by the laws of Northern Ireland. The courts of Northern Ireland will have non-exclusive jurisdiction in relation to any dispute.
