1. Who we are
Energy 106 is a commercial radio service broadcasting in Northern Ireland and online.
References to “you” and “your” mean users of the Site.

2. Using the Site
2.1 You may use the Site for lawful, personal and non-commercial purposes only.
2.2 You must not:
2.2.1 use the Site in any unlawful, fraudulent or harmful way;
2.2.2 damage, interfere with, disrupt or overload the Site, streams, servers or systems;
2.2.3 attempt to gain unauthorised access to the Site, our systems or any connected systems;
2.2.4 reverse-engineer, decompile, scrape, crawl, data-mine or extract content from the Site except where permitted by law;
2.2.5 copy, record, rebroadcast, redistribute, resell or commercially exploit our audio streams, website content or other materials without our prior written permission;
2.2.6 upload, transmit or submit anything unlawful, defamatory, misleading, obscene, hateful, abusive, discriminatory, threatening, infringing or otherwise objectionable;
2.2.7 impersonate any person or organisation; or
2.2.8 use the Site in a way that could damage our reputation or the reputation of our presenters, partners, advertisers or suppliers.
2.3 We may suspend, restrict or terminate access to the Site if we reasonably believe you have breached these Terms or misused the Site.
3. Accounts and interactive features
3.1 Some features, such as competitions, forms, newsletters, requests, messages, comments or other interactive areas, may require you to provide information.
3.2 You must ensure that any information you provide is accurate, complete and up to date.
3.3 If any feature requires login details, you must keep those details confidential and must not allow anyone else to use your account.

4.3 Energy 106, AdSync, our logos, show names and related branding are trade marks or are used with permission.
4.4 You may:
4.4.1 view pages on the Site;
4.4.2 stream audio for personal, non-commercial listening;
4.4.3 print or download a single copy of pages for personal use; and
4.4.4 link to our homepage or publicly available pages in a way that is fair, legal and does not damage our reputation.
4.5 You must not use our content, streams, branding, trade marks or materials for any commercial purpose without our prior written consent.
4.6 You must not suggest that Energy 106 endorses you, your business, your website, your product or your service unless we have agreed this in writing.
5. Streaming, apps and smart speakers
5.1 We may provide access to live streams, audio, video, clips, podcasts or on-demand content through the Site, our apps, Radioplayer UK, TuneIn, smart speakers, social media platforms and other approved platforms.
5.2 Availability, quality and functionality may vary depending on your device, browser, operating system, location, platform, connection and third-party services.
5.3 Data charges, mobile charges or other charges from your provider may apply.
5.4 We may update, suspend, restrict, replace or withdraw any stream, app, platform integration, audio feed, show, feature or content at any time without notice.
5.5 We do not guarantee that any stream, app, platform integration or smart-speaker service will always be available, uninterrupted, accurate or error-free.
6. Advertising, sponsorships, links and third-party services
6.1 The Site, our streams and our digital services may include advertising, sponsorships, promotions, affiliate links, embedded content, third-party players, social media features or links to third-party websites and services.
6.2 Third-party websites, platforms and services are not controlled by us.
6.3 We are not responsible for third-party content, availability, accuracy, privacy practices, cookies, terms, products, services or actions.
6.4 Any dealings you have with advertisers, sponsors, partners, platforms or third parties are between you and them.

7.3 Competition-specific terms may also apply to individual competitions or promotions.
7.4 If there is a conflict between these Terms and any Competition-specific terms, the Competition-specific terms will take priority for that competition or promotion.
8. User content and submissions
8.1 If you submit, upload, send or provide content to us, including messages, requests, shout-outs, voice notes, audio, video, photographs, comments, competition entries or social media posts, you grant us a worldwide, non-exclusive, royalty-free licence to use, reproduce, edit, adapt, broadcast, publish, display, distribute and communicate that content in connection with Energy 106, our programming, competitions, promotions, website, social media and services.
8.2 You confirm that:
8.2.1 you have the right to provide the content to us;
8.2.2 you have obtained permission from anyone featured or identifiable in the content;
8.2.3 our use of the content will not infringe anyone’s rights;
8.2.4 the content is not unlawful, defamatory, misleading, obscene, abusive, discriminatory, hateful, threatening, harmful or otherwise objectionable; and
8.2.5 the content does not contain viruses, malware or anything that could damage our systems or services.
8.3 We may edit, moderate, refuse, remove or delete user content at our discretion.
8.4 We are not required to publish, broadcast or respond to any content you submit.
8.5 Please do not send us anything you do not want potentially broadcast, published or shared.
