What to include in your complaint
Providing the details below helps us locate the relevant broadcast, advert, competition or issue and respond quickly:
- Date and time of the issue, using UK time
- Programme, show, advert, competition or promotion name
- Presenter, advertiser or sponsor, if known
- Where you listened or saw the content, for example DAB Block 9A or 9C, smart speaker, app, web player, website or social media
- A short description of what happened
- Why you are complaining
- Any supporting information, such as screenshots, links, messages or recordings, if relevant
- Your name and preferred contact details
Important: We keep recordings of our broadcast output for 42 days after transmission. Please raise broadcast concerns as soon as possible so we can review the relevant audio.
Our process and timelines
Acknowledgement
We aim to acknowledge your complaint within 2 working days.
Investigation and response
We normally aim to provide a written response within 10 working days.
Complex cases may take longer. If this happens, we will let you know and give you an updated timescale where possible.
Escalation
If you are unhappy with our response, you can ask for a review by our Programme Controller by emailing:
Please explain why you remain dissatisfied and include any additional information you would like us to consider.
Complaints about programmes: Ofcom
If you believe a programme may have breached the Ofcom Broadcasting Code, for example due to harm and offence, due impartiality, fairness, privacy, or protection of under-18s, you can complain to us or directly to Ofcom.
Ofcom – TV, radio or on-demand complaints:
https://www.ofcom.org.uk/make-a-complaint/complain-about-tv-radio-or-on-demand-services
Ofcom may ask whether you have contacted the broadcaster first. In many cases it is helpful to do so, but you may complain to Ofcom at any time. Ofcom’s complaints page covers TV, radio and on-demand programme complaints.
Complaints about advertising and prize promotions: ASA
Concerns about advertisements heard on Energy 106, or about a special offer, competition or prize promotion being unfairly run, may be handled by the Advertising Standards Authority.
ASA – Make a complaint:
https://www.asa.org.uk/make-a-complaint.html
You can also contact us and we will help point you to the right place. ASA says you can complain if you think there is something wrong with an ad you have seen or heard, or if you think a special offer, competition or prize promotion has been unfairly run.
Data protection and privacy complaints
If your complaint relates to personal data, privacy, marketing consent or how we handled your information, please contact:
Please include enough detail for us to understand and investigate your concern.
We will consider data protection complaints fairly and will normally aim to respond within one month, unless the matter is complex or we need further information.
You also have the right to complain to the Information Commissioner’s Office if you are unhappy with our response or with how your personal data has been handled.
ICO – Make a complaint:
https://ico.org.uk/make-a-complaint/
The ICO has also published guidance on data protection complaints under the Data (Use and Access) Act, with new requirements due to come into force on 19 June 2026.
Competitions
We aim to run competitions, prize draws and promotions fairly and in line with the rules we publish for each competition.
If you have a competition complaint, please include:
- The competition name
- Where and when it was promoted
- How you entered
- Any screenshots, messages, call logs or confirmations you received
- A short explanation of your concern
As part of our investigation, we may review the entry process, winner selection process, eligibility checks, relevant broadcast material and prize fulfilment records.
If a competition is run by, sponsored by or fulfilled by an advertiser, partner or prize provider, we may need to share relevant details with them so the issue can be investigated and resolved.
Accessibility
We can provide this complaints process in alternative formats and will make reasonable adjustments if you need them.
Please email:
and tell us what support or format you need.
Confidentiality
We will handle complaints confidentially where possible.
We may need to share information internally, with our advisers, with relevant partners or suppliers, or with regulators such as Ofcom, ASA or the ICO where necessary to investigate or respond to a complaint.
Vexatious, abusive or unreasonable complaints
We may decline to continue handling a complaint where communications are abusive, threatening, discriminatory, repeatedly unreasonable, or where the complaint has already been fully considered and no new information has been provided.
We will not do this lightly, and we will explain our position where appropriate.
